The 2017 GMAC® “GMAT Study Playlist” Drawing – Official Rules


BINDING AGREEMENT: These Official Rules (“Rules”) will provide you with the information you need to successfully enter the Drawing. These Rules form a binding contract between the Graduate Management Admission Council® ("GMAC®") and you as an entrant into the Drawing.  By entering you agree to be bound by these Rules.  If you breach a provision of these Rules, you will forfeit your entry into the Drawing. If you have questions, please contact GMAC at

ELIGIBILITY: To be eligible to enter this Contest, you must be (i) above the age of majority in the jurisdiction in which you reside at the time of entry, ii) submit an entry as described below under “How to Enter” during the Drawing Term. Current employees, directors, and officers of GMAC, their affiliates, agents and their immediate families and those living in their household, are not eligible to participate in the Drawing. OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES. VOID WHERE PROHIBITED OR RESTRICTED. All federal, state, and local laws and regulations apply.

DRAWING SPONSOR: Graduate Management Admission Council®, P. O. Box 2969, Reston VA 20195 USA, is the sponsor of the Drawing (“Sponsor” or “GMAC”).

CONTEST TERM: The Contest will begin at 12:00.01 am eastern daylight time (EDT) on March 20, 2017, and ends at 11:59:59 pm EDT on April 7, 2017 (“Drawing Term”).

To Enter the Drawing for the Prize: You must access the Drawing Website at] (the "Contest Website") From there, an individual must do the following:

  • Create an entry by submitting your “favorite study song” to create a collaborative Spotify playlist of music GMAT users can use to study with.
  • Users will need to submit their song/track by using their spotify account.
  • Users will be provided the option to share the playlist with friends on Facebook, Instagram and Twitter
  • Users must provide their name, email address, state and name of their undergraduate institution

Submission Requirements: 
To be eligible for the Prize, the submission must meet the following requirements (“Requirements”): 

(I) song/track pick must not contain any content that Sponsor, in its sole discretion, deems to be objectionable, including any image or concept that is derogatory, unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, invasive of another's privacy, tortuous, or contain explicit or graphic descriptions or accounts of, sexual acts. Entrants must comply with any Spotify terms and conditions regarding the use of any of its services.

LIMIT: ONE (1) ENTRY PER PERSON FOR THE PRIZE. Duplicate entries will be disqualified and will not be entered in the Contest.

All entrants must provide the following information: a name, an email address, state, and undergraduate institution.. The email address you provide will be our primary means of communication with the entrant. All entries must be submitted in English. Once you submit your entry, no further changes can be made to the entry even if there is time remaining in the Term.

In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A selected entrant may be required to provide GMAC with proof that he/she is the authorized account holder of the email address associated with the selected entry. 

By entering the Contest, all entrants grant an irrevocable, perpetual, worldwide non-exclusive license to GMAC, to reproduce, distribute, display, publicly perform and create derivative works of the entries (along with a name credit) in connection with the Contest and promotion of the Contest, in any media now or hereafter known. Entrants consent to GMAC doing or omitting to do any act that would otherwise infringe the entrant’s “moral rights” in their entries. Display or publication of any entry on Sponsor’s website does not indicate the entrant will be selected as a winner. GMAC will not be required to pay any additional consideration or seek any additional approval in connection with such use.

ELECTRONIC COMMUNICATIONS: By submitting your Drawing entry, whether by email or regular mail, you agree to communicate for the purpose of this Drawing with Sponsor electronically. By agreeing to do business electronically, you (i) agree that your consent to these Rules is a binding form of your electronic signature, which you agree binds you to these Rules, (ii) represent that you have Internet access and a valid email address enabling you access to the Drawing Site and to receive communications and documents electronically, and (iii) represent that you have a printer or other device to print or otherwise save communications and documents including, without limitation, these Rules and that you have, in fact, printed or otherwise saved a copy of these Rules for your records. This consent is effective unless and until you withdraw it. You may withdraw your consent to electronic communication and delivery of documents, update your contact information, or request a free paper copy of these Rules at any time by contacting us as set forth in these Rules. We will send you a confirmation notice once we have processed your change request.

  • Total ARV of all prizes is US $314.82 Prizes will be delivered by email or regular mail as applicable. Winner will need to provide their mailing address for mail delivery depending on the type of prize awarded. Winner is responsible for any and all taxes. Odds of winning depend on the number of eligible entries received.

WINNER SELECTION: On or about 11:30 am EDT on April 11, 2017, Sponsor will randomly select the prize winner from all eligible entrants. All decisions on all matters pertaining to the Drawing are final. Winner is responsible for any and all taxes, delivery fees, and/or costs related to the processing, maintenance, set up or receipt of the prize by the winner. Sponsor reserves the right to substitute a prize of equal or greater value.

WINNER NOTIFICATION: Prize drawing will be conducted at Sponsor’s office in Reston, Virginia. The potential winner will be notified following the selection of the winner as specified above on April 11, 2017. Potential winner will have 3 days from notification to claim his or her prize. Winner may be required to complete a release and provide tax identification or other information prior to receiving their prize. Sponsor and its affiliates, subsidiaries, employees, agents, officers and directors, advertising and marketing agencies, and their respective officers, directors, employees, and their respective agents will not be liable for unsuccessful efforts to notify a winner. No prize transfer, assignment, or substitution by winner permitted. All federal, state, and local taxes, fees, duties and surcharges, if any, on the prize are the sole responsibility of the winners. If any potential winners fails to respond to the prize notification within 3 days, declines the prize, fails to claim the prize, is unavailable for prize fulfillment, fails to abide by the Rules, or is ineligible, Sponsor may select an alternate winner from a list of back-up winners selected at each draw. If any prize or prize notification is refused, ignored or returned as undeliverable, that prize is forfeited and Sponsor may select an alternate winner from a list of back-up winners selected at the draw.

LIMITATION OF LIABILITY: Entrants and winner individually and on behalf of their relatives, heirs, assignees, executors, and administrators, hereby permanently, irrevocably and forever waive and release any and all rights, demands, losses, liabilities, claims and causes of action whatsoever which you may now or hereafter be entitled to assert against Sponsor, its affiliates, parent, and subsidiary companies, its employees, agents and officers, advertising, marketing and promotion agencies, as well as all others associated with the development and execution of the Drawing (collectively, the “Released Parties”), including, but not limited to any death, injury, loss of enjoyment or other harm or loss of any nature whatsoever caused by, contributed to, or arising out of the Drawing and/or any prize awarded, any claim or demand for additional compensation or any other claim or demand related to the Drawing or what the Sponsor provides, and forever release and discharge the Released Parties from any and all liability with respect thereto. The Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Drawing entries or entry forms; or alteration of entries or entry forms, or any registration or winner selection. WITHOUT LIMITING THE FOREGOING, AND EXCEPT WHERE PROHIBITED BY LAW, EVERYTHING REGARDING THIS DRAWING, INCLUDING THE PRIZE, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

CONDITIONS: Entrants agree (a) to be bound by these Rules; (b) the transfer of your personal information and your entry to the United States, where GMAC and its data processors are located, and the use of your entry by GMAC; and (c) All entries become the property of GMAC and will not be acknowledged or returned. GMAC is not responsible for: (i) lost, late, incomplete, invalid, illegible, or misdirected entries, which will be disqualified; (ii) for failed, partial or garbled computer transmissions; (iii) for technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware or software; or (iv) for any error, technical or otherwise. GMAC reserves the right, in its sole discretion, to disqualify any entry not in compliance with these Rules.

You acknowledge and agree that GMAC may keep your entry indefinitely and disclose it for any purpose, including but not limited to: (a) comply with legal process; (b) enforce these Rules; (c) respond to claims that any entry violates the rights of third-parties; or (d) without undertaking a duty to do so, protect the rights, property, or personal safety, of our users and the public.

If you are acting within the scope of your employment, as an employee, contractor, or agent of another party, you warrant that such party has full knowledge of your actions and has consent thereto. You further warrant that your actions do not violate your employer’s or company’s policies and procedures.

RIGHT TO DISQUALIFY, MODIFY, CANCEL OR SUSPEND: GMAC reserves the right, at its sole discretion, to: disqualify any individual(s) who tamper with the entry process; and/or to cancel, terminate, modify, or suspend the Drawing. GMAC reserves the right to disqualify any entry from this or any future Drawing if, in its sole discretion, GMAC reasonably believes that any person has attempted to undermine the legitimate operation of GMAC or the website by cheating, deception, or other unfair practices, or has tampered with any of GMAC's websites, the submission process, the judging process, violates these Rules, or acts in an unsportsmanlike or disruptive manner, or annoys, abuses, threatens, or harasses GMAC, its agents, its assigns or any other entrant.

PUBLICITY: Acceptance of any prize related to this Drawing constitutes permission for, and winner’s consent to, GMAC and its agencies or assigns to use the entry and the names and/or likenesses of any winner for advertising and promotional purposes, in any media now or hereafter known, without further notice, compensation, consideration, review, or consent, except as prohibited by law.

GOVERNING LAW: The Drawing and the rights and obligations of all entrants and entries shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, USA without effect to any principles of conflicts of law, and the federal law of the United States. Should any provision of these Rules be held to be void, invalid, unenforceable, or illegal by a proper legal authority, the validity and enforceability of the other provisions shall not be affected.

DISPUTE RESOLUTION: All disputes, claims or demands that relate to these Rules will first be brought to the attention of the other party and will be resolved individually, without resort to any form of class action. The receiving party shall have sixty (60) days from the date of such notice to remedy the described breach or violation and notify the complaining party in writing of the resolution. If the dispute, claim or demand is not resolved to the satisfaction of the complainant within 60 days, the complainant may request an informal resolution conference (mediation), which if agreed to by the other party will be scheduled to occur within 21 days of the written response. Each party shall have the right to be represented at such a conference by counsel and will ensure that a decision-maker with full and complete authority to resolve the dispute attends the conference. Such conference will be in front of a third party mediator chosen by the parties. If the parties do not agree to conference or are unable to resolve a dispute after such a conference, the parties agree that exclusive jurisdiction for any dispute, claim or demand related in any way to these Official Rules will be decided by binding arbitration. All disputes between the parties, of whatsoever kind or nature arising out of these Official Rules, shall be submitted to JAMS ( for binding arbitration under its rules then in effect in the Washington, DC area, before one arbitrator to be mutually agreed upon by both parties. The parties agree to share equally in the arbitration costs incurred.

DATA PRIVACY: Your personal information will be used to fulfill the terms of this Drawing and may therefore be shared with any subcontractor, agent or partner that assists or is otherwise involved in the Drawing or website operation; and in addition, your information, including your email, may be used by Sponsor to contact you about its products and services, surveys, schools, scholarship and other programs.
